Crime Patrol - Episode 130 - 14th July 2012













यह कहानी एक ऐसी लड़की की है, जिसका इस दुनिया में कोई नहीं है. पिछले पांच सालों से वह डिस्ट्रिक्ट जेल में उस अपराध की सजा काट रही, जो शायद उसने किया ही नहीं. उन्नीस साल की उम्र में जब और लड़कियां हसीन सपने बुन रही होती हैं, तो जेल की अंधेरी कोठरी में वह आंसुओं में डूबी है. उसकी खता सिर्फ इतनी थी कि वह गरीब थी.


गरीबी का कहर, छूटता रहा अपनों का साथ
सीमा के होश संभालते ही मुसीबतों का पहाड़ टूटने लगा. मां-बाप और एक छोटे भाई के साथ उसकी फैमिली किराए के मकान में रहती थी. उस समय उसकी उम्र लगभग 9 साल थी. घर की आर्थिक स्थिति काफी कमजोर थी. एक दिन मकान मालिक ने सीमा की फैमिली को अचानक रात में घर से निकाल दिया. पूरा परिवार सड़क पर आ गया. मगर इससे बड़ी मुसीबत तब आई, जब उसके पिता परिवार को छोड़कर कहीं चले गए. मां ने किसी तरह कुछ दिन तक सीमा और उसके भाई का पालन-पोषण किया. अभी दिन सुधरे ही थे कि सीमा पर एक और पहाड़ टूट पड़ा, जब एक दिन उसकी मां उसके छोटे भाई को लेकर अचानक गायब हो गई. मां की तलाश में सीमा दर-दर भटकती रही. एक ओर मां का दुख था तो दूसरी ओर भूख सता रही थी.


मसीहा बनकर आया टैक्सी ड्राइवर
मां-बाप और भाई से बिछुडऩे के बाद सीमा बिल्कुल अकेले पड़ गई थी. कई दिनों तक सड़कों पर भूखे-नंगे घूमते रहने के बाद सीमा को टैक्सी ड्राइवर के रूप में एक मसीहा मिला. उसने पूरी कहानी सुनने के बाद सीमा को अपने घर में शरण दी. कुछ दिन घर में रखने के बाद उस टैक्सी ड्राइवर ने सीमा को अपने एक रिलेटिव के घर छोड़ दिया. वहां सीमा मेड के रूप में रहने लगी. सीमा भी किस्मत के इस फैसले से खुश थी कि कम से कम थोड़े काम के बदले घर और खाना तो मिलेगा.


पांच साल बाद फिर टूटा पहाड़
सीमा ट्रैक्सी ड्राइवर के रिलेटिव के घर मेड के रूप में आराम से रह रही थी. 5 साल बीत गए, मगर सीमा की लाइफ में किसी तरह की कोई प्रॉब्लम नहीं हुई. मगर शायद किस्मत को यह मंजूर नहीं था. जिस घर में सीमा रह रही थी, अचानक उसका मालकिन से विवाद हो गया. बात इतनी बढ़ गई कि मालकिन ने सीमा के खिलाफ चोरी की रिपोर्ट दर्ज करा दी. घटना की असलियत क्या थी, यह कहना तो मुश्किल होगा, मगर सीमा को चोरी के आरोप में पुलिस ने गिरफ्तार कर लिया. तब वह नाबालिग थी. सीमा को पुलिस ने मिर्जापुर जेल भेज दिया.


मामला अभी ट्रायल में
गोरखपुर डिस्ट्रिक्ट जेल में बंद सीमा के अनुसार, बालिग होने पर ही सीमा को गोरखपुर जेल भेज दिया गया. सीमा अब तक लगभग 5 साल की 'सजाÓ काट चुकी है. मगर उसका मामला अभी ट्रायल पर है. वह जेल से कब तक छूटेगी यह कहना मुश्किल होगा, क्योंकि सीमा की न तो कोई जमानत कराने वाला है और न ही केस की जल्द सुनवाई कराने वाला. मगर सीमा की इस कहानी ने यह तय कर दिया कि जिसका कोई नहीं होता, उसे सिर्फ मुसीबतों का ही सामना करना पड़ता है. जेलर ने बताया कि सीमा चोरी के आरोप में बंद है. जब तक उसे सजा सुनाई नहीं जाती, तब तक वह यही रहेगी. क्योंकि उसकी जमानत कराने वाला कोई नहीं है.

Social activist shot at; accuses mafia for attack



VARANASI: A homeopath practitioner and social activist, Amarnath Pandey suffered pellet injuries on his head in mysterious circumstances at Robertsganj area under the same police station in Sonebhadra district on Wednesday.



Pandey had been in the limelight in recent past for exposing the malpractice committed to allegedly grab the funds of Mahatma Gandhi National Rural Employment Guarantee Scheme (MNREGS) by mafia in Ghorawal block.



According to reports, he was returning home from the market on the night of Wednesday. When he reached close to his house some unidentified miscreants opened fire at him and fled from the scene. Pandey had a narrow escape as he suffered a minor injury on his head in this attack. He was immediately taken to district hospital. Later, Pandey alleged that the MNREGS mafia had engineered the attack on him. However, when SP Sonebhadra, Deepak Kumar, was contacted on Thursday, he said that Pandey had sustained pellet injury but the empty shell, which he claimed to have recovered from the incident site, was of .32 bore. This fact makes the episode sound fishy.



However, Kumar said, the allegations of Pandey have been taken seriously and a probe into the matter is on.



Meanwhile, in protest against the attack on Pandey, scores of social activists staged a demonstration in Badauli Chawk area. They demanded that the police arrest the assailants at the earliest.

Sonbhadra, Uttar Pradesh: A right to information activist Dr Amar Nath Pandey has been shot at in the Sonbhadra district of Uttar Pradesh reportedly for seeking information on corruption in the implementation of MNREGA schemes in the area and exposing district level corruption.



This was the second attempt on his life in the last one week when a jeep had tried to run him over.



The main suspect, the Block Development Officer, was suspended after his expose.



''I was coming back after consulting a child specialist regarding viral fever of my grandson. In the narrow alley near Bechu Halwai that goes up to Sonbhadra Pathologist centre through Samsuddin's house, a person came running from behind, fired and fled," said RTI activist Dr Amar Nath Pandey.



Pandey informed us that he was shot at. Prima facie, he is out of danger and was talking despite being fired upon. He said that he has been raising voice against Gharaulia block BDO (Rajesh Yadav), who attacked him in an act of immediate rage. FIR has been lodged against Rajesh Yadav, Rajesh Dubey and one more person," said Deepak Kumar Superintendent of Police, Sonbhadra.



Pandey's RTI query had revealed that local roads were being constructed under NREGA with a sanction of 24 rupees for each brick.



When in reality the bricks cost no more than four rupees apiece.



Money had been sanctioned to repair old roads, though on paper they were classified as new road constructions.



Also, NREGA money was being paid to job cards issued in the name of dead people.



Sonbhadra residents have mobilised in support of their hero but the lack of protection for whistleblowers means they have to fight the battle on many fronts.

Bhopal: The special task force (STF) is learnt to have solved the mystery behind the sensational murder of journalist Chandrika Rai and his family in Umaria following arrest of five persons, who were allegedly involved in the kidnapping of a PWD officer’s son.



The accused, said sources, are residents of Shahdol and were involved in kidnapping of SDO Hemant Jharia’s son Anant (7). The accused murdered Chandrika on suspicion that he was in possession of the ransom money given by SDO for his son’s release, said sources.



On last Sunday, when the accused approached Chandrika demanding the ransom money, he denied. This allegedly led to an altercation between Rai and the kidnappers. They attacked Chandrika with iron rods and other heavy objects, killing him on the spot.



“After killing Rai, the accused eliminated his wife and two children to ensure no witnesses were left,” said a police officer wishing anonymity.



“It’s clear that these five were involved in kidnapping and the murder but whether or not Chandrika was involved, is yet to be confirmed. We cannot simply rely on what these criminals claim” the officer said. Investigation is still on to collect corroborative evidences.



Director General of Police (DGP) SK Rout is likely to make an official announcement of the case on Friday evening. After SDO Hemant Jharia’s son Anant was released by abductors on February 18 , the Umeria police had called a press conference to announce this, and gave a clean chit to the two suspects they had rounded up. They had also said that the release was made without ransom. The murders took place a few hours after the press meet.



“We hope to soon solve the mystery behind the murder which was committed by professional persons,” STF additional director general of police (ADGP) Sanjay Choudhry told reporters in Umaria.



He reached there to inspect the murder site and visited the house of the slain journalist before leaving for Nourojabad in connection with the incident.



PCI team to visit Umaria: The three-member team fact-finding team of the press council would be headed by Kosuri Amarnath and include Rajeev Ranjan Nag and Kalyan Barooah, a council statement said. All the three are members of the council. The task before the team is to investigate into the murders and submit a report to the council at the earliest.



The council sought the cooperation of the state authorities on behalf of its team.



“The Madhya Pradesh authorities are being requested to give all cooperation to this committee so that it can discharge its duties effectively,” the statement said. The Council has been taking the issue of journalists security with several state governments.



BHOPAL: A seven-year-old boy, the son of a sub-divisional officer (SDO) of the public works department (PWD), was allegedly abducted from Umaria town on Wednesday evening. The police have no clues about the child or the identity of abductors even 24 hours after the incident. It is the third incident of kidnapping in three days in the state. On February 13, a 14-year-old boy, the son of an industrialist was abducted from Bhopal. The next day, a son of trader was kidnapped from Ratlam.



The victim's family reportedly received ransom calls demanding Rs 6 lakh for the release of the child. Though tight-lipped about the case, the police admitted that calls were received from neighbouring Uttar Pradesh. The police have not succeeded so far in tracing the origin of calls.



"The case is under investigation. We are not in a position to reveal anything,'' SP Manohar Singh Jhamra told TOI. Sources in the police department, however, said a team comprising an additional SP and three investigating officers is being sent to Uttar Pradesh.



The kidnapped boy, Anant Jhariya, is a student of class II. The son of SDO PWD (electrical and mechanical) Hemant Jhariya, Anant, had gone to tutorial classes with a friend. After tutorials, the two boys walked together till the stadium before going their ways. Anant, who was last seen walking towards his home alone, went missing between 6 and 7 pm, the police said. When the boy did not reach home, his parents began looking for him.

सत्येन्द्र कुमार दूबे का जन्म बिहार के सिवान जिले में हुआ था। वे भारतीय राष्ट्रीय राजमार्ग प्राधिकरण में परियोजना निदेशक के पद पर कार्यरत थे। सत्येन्द्र दूबे द्वारा स्वर्णिम चतुर्भुज परियोजना में व्याप्त भ्रष्टाचार को जनता के सामने लाये जाने के कारण उनकी हत्या 27 नवंबर 2003 में गया जिले में हो गई थी।



प्रारंभिक जीवन और शिक्षा



सत्येन्द्र के पिता का नाम श्री बागेश्वरी दूबे और माता का नाम श्रीमती फूलमती देवी था। उनका जन्म बिहार प्रांत के सिवान जिले के शाहपुर ग्राम में हुआ था। मध्यम वर्गीय परिवार में जन्मे सत्येन्द्र ने 15 वर्ष की आयु तक की अपनी प्रारंभिक शिक्षा अपने गांव में ही प्राप्त की और उसके बाद आगे की शिक्षा के लिए इलाहाबाद चले आए। इलाहाबाद में इनका विद्यार्थी जीवन बड़ा ही संघर्षपूर्ण था। इसके पश्चात 1990 में इन्होंने भारतीय प्रौद्योगिकी संस्थान के सिविल अभियांत्रिकी विभाग में प्रवेश लिया और 1994 में स्नातक की परीक्षा उत्तीर्ण की। इसके पश्चात इन्होंने काशी हिन्दू विश्वविद्यालय में परास्नातक में प्रवेश लिया और यह परीक्षा सम्मान के साथ उत्तीर्ण किया। बचपन से ही सत्येन्द्र की गणना प्रतिभाशाली विद्यार्थियों में होती थी।



बाद का जीवन



सत्येन्द्र ने भारतीय अभियांत्रिकी सेवा की परीक्षा उत्तीर्ण की जिसके परिणाम स्वरूप उन्हें सन् 2002 में भारतीय राष्ट्रीय राजमार्ग प्राधिकरण में परियोजना निदेशक का पद मिला। इस पद पर काम करते समय उन्हें स्वर्णिम चतुर्भुज परियोजना में कार्य करने का मौका मिला। इस परियोजना में कार्य करते समय उन्हें बहुत बडे़ स्तर पर हो रहे भ्रष्टाचार और वित्तीय अनियमिताओं का पता चला। विभाग के ठेकेदारों और इंजिनियरों की साठ-गाठ से भ्रष्टाचार का धंधा खूब फल फूल रहा था। सत्येन्द्र ने अपने ही विभाग के कुछ भ्रष्ट अधिकारियों और इंजीनियरों के खिलाफ कार्यवाही की और उन्हें निलंबित किया।



भ्रष्टाचार के खिलाफ संघर्ष



सत्येन्द्र ने इसके बाद भ्रष्टाचार के खिलाफ एक मुहीम शुरू कर दी और अपने विभाग में हो रही दूसरी अनियमितताओं पर भी ध्यान केन्द्रित किया। उन्होंने इन अनियमितताओं के बारे में अपने विभाग के निदेशक और अन्य अधिकारियों को पत्र भी लिखा लेकिन किसी ने भी उनकी बातों पर ध्यान नहीं दिया। इन शिकायतों के परिणाम स्वरूप उनका स्थानांतरण गया जिले में कर दिया गया। गया जिले में भी उन्होंने अपनी भ्रष्टाचार के विरुद्ध मुहीम में कोई कमी नहीं आने दी। सत्येन्द्र को इन सभी के फलस्वरूप धमकियां भी मिली।

प्रधानमंत्री को पत्र



उच्च स्तर पर व्याप्त भ्रष्टाचार को देखते हुए सत्येन्द्र ने इसकी शिकायत प्रधानमंत्री से करने का निर्णय लिया और एक विस्तृत पत्र लिखा। उस गोपनीय पत्र में सत्येन्द्र ने भ्रष्टाचार पर विधिवत प्रकाश डाला और उसे प्रधानमंत्री कार्यालय को भेज दिया। भ्रष्टाचार की गंभीरता को देखते हुए सत्येन्द्र ने उस पत्र में अपना नाम गोपनीय रखने का अनुरोध किया था। बाद में यह देखा गया कि सत्येन्द्र के अनुरोध के बाद भी कार्यालय अधिकारियों ने उस पत्र को सत्येन्द्र के नाम के साथ अलग अलग विभागों में अग्रसारित कर दिया।



सत्येन्द्र की हत्या



सत्येन्द्र की हत्या तब हो गई जब वे बनारस से एक विवाह समारोह के बाद घर लौट रहे थे। वे बनारस से गया तक ट्रेन द्वारा पहुंचे और उसके बाद गया स्टेशन से रिक्से द्वारा घर जाते समय रास्ते में गोली मार उनकी हत्या की गई। गया में जे.पी. कॉलोनी के रास्ते में उनका मृत शरीर पाया गया। सत्येन्द्र की मृत्यु ने लोक सभा तक को आंदोलित किया। देश में हो रहे विरोध प्रदर्शनों और सामान्य जनता के असंतोष को देखते हुए सरकार द्वारा उनकी मृत्यु की जांच केन्द्रीय अन्वेषण ब्यूरो को सौंप दिया गया।



भ्रष्टाचार के विरुद्ध आंदोलन



सत्येन्द्र की हत्या से राजनीतिक और सामाजिक स्तर पर एक भूचाल आ गया। भ्रष्टाचार के खिलाफ काम करने वाली अन्य संस्थाओं ने इस मामले को उठाया। जिसके परिणामस्वरूप सरकार को नीतिगत स्तर पर भ्रष्टाचार को उजागर करने वाले लोगों की पहचान सुरक्षित रखने का नियम बनाना पड़ा। सत्येन्द्र के बलिदान का एक यह सबसे बड़ा परिणाम हुआ कि सरकारी विभागों के भ्रष्ट अधिकारी इमानदार लोगों से डरने लगे। बाद के वर्षों में आया सूचना का अधिकार अधिनियम इस दिशा में मील का एक पत्थर साबित हुआ। यह नियम भ्रष्टाचार को उजागर वाले व्यक्तियों के लिए एक हथियार साबित हुआ।

सत्येन्द्र दुबे हत्याकांड: दोषियों को उम्रकैद मिली

पटना। प्राधिकरण राष्ट्रीय राजमार्ग के अभियंता और प्रधानमंत्री स्वर्णिम चतुर्भज सड़क निर्माण योजना के परियोजना अधिकारी सत्येन्द्र दुबे की हत्या के मामले में विशेष अदालत ने तीन दोषियों को आजीवन कारावास की सजा सुनाई।


उल्लेखनीय है कि बेहद ईमानदार, कर्मठ और निर्भीक अधिकारी के रूप में चर्चित रहे श्री दुबे की बिहार के गया शहर में 27 नवंबर 2003 को हत्या हुई जिसे लेकर राजनीतिक और सामाजिक स्तर पर काफी हंगामा हुआ था और मामले की जांच केन्द्रीय जांच ब्यूरो (सीबीआई) को सौंप दी गयी थी। हत्या के समय सत्येन्द्र प्रधानमंत्री स्वर्णिम चतुर्भुज सड़क निर्माण योजना के परियोजना अधिकारी के रूप में गया जिले में तैनात थे। परियोजना पदाधिकारी के रूप में अपनी पदस्थापना के दौरान सत्येन्द्र ने विभाग में कथित रूप से व्याप्त भ्रष्टाचार के संबंध में सीधे प्रधानमंत्री कार्यालय को पत्र लिखकर सूचित किया था।


अचानक हुई उनकी हत्या के कारण इस बात की आशंका व्यक्त की गयी थी कि कहीं किसी साजिश के तहत उनकी हत्या न की गयी हो। इसी बात को लेकर मामला काफी चर्चित हुआ था। मामले की प्राथमिकी भी आपराधिक षड़यंत्र के तहत की गयी हत्या भारतीय दंड विधान की धारा 302 और 120 बी के तहत दर्ज की गयी थी।


अनुसंधान की जिम्मेदारी संभालने के बाद सीबीआई ने कई दृष्टिकोण से इस मामले की जांच की। इस दौरान भी यह मामला काफी चर्चित रहा और अखबारों की सुर्खियां बटोरता रहा। मामले की जांच के दौरान गया जिले के एक व्यक्ति की मौत को लेकर सीबीआई को भी काफी परेशानियों का सामना करना पड़ा था लेकिन ब्यूरो के वरिष्ठ पदाधिकारियों की देख-रेख में मामले की जांच जारी रही।


मामले की जांच के दौरान सीबीआई न केवल असली दोषियों तक पहुंचने में सफल रही बल्कि उसने सत्येन्द्र दुबे के लूटे गये सामान को भी बरामद करने में सफलता हासिल की।


जांच के बाद तीन सितम्बर 2004 को सीबीआई ने इस मामले में आरोप पत्र दाखिल किया तब भी यह मामला चर्चा का विषय बना।


सीबीआई ने मामले में छह लोगों को गिरफ्तार किया था, जिनमें से तीन लोगों का विचारण करने और एक अभियुक्त श्रवण कुमार को वायदा माफ गवाह बनाया था। दो अन्य अभियुक्तों के खिलाफ साक्ष्य नहीं पाया गया। सीबीआई ने अपनी जांच में पेशेवर चोरों और लुटेरों द्वारा लूटपाट के दौरान सत्येन्द्र दुबे की हत्या होने का मामला पाया था।


सीबीआई ने किसी आपराधिक षड़यंत्र के तहत सत्येन्द्र दुबे की हत्या किये जाने का सबूत नहीं पाया और भारतीय दंड विधान की धारा 302, 394 तथा शस्त्र अधिनियम की धारा 27 के तहत न्यायालय में आरोप पत्र दाखिल किया था।


अदालत में दाखिल आरोप पत्र और सुनवाई के दौरान गवाहों के बयान से जो मामला उभकर सामने आया उसके अनुसार सत्येन्द्र दुबे अपनी बहन की शादी की बातचीत के सिलसिले में गया से बाहर गये थे और घटना की रात्रि में गया रेलवे स्टेशन से अपने सरकारी आवास को लौट रहे थे कि गया परिसदन के नजदीक अपराधियों ने उन्हें घेर लिया और लूटपाट करने लगे। अभियंता दुबे के हाथ में एक अटैची थी और उसमें उसकी बहन की जन्म कुंडली और फोटो तथा कुछ अन्य जरूरी कागजात थे।
लुटेरों ने जब अटैची छीनने की कोशिश की तो अभियंता दुबे ने इसका विरोध किया। इसी बीच एक लुटेरे मंटू कुमार ने उन्हें पिस्तौल से गोली मार दी जिससे उनकी मौत हो गयी।




बिहार के मूल निवासी अभियंता सत्येन्द दुबे ने अपनी इंजीनियरिंग की पढ़ाई भारतीय प्रौद्योगिकी संस्थान (आईआईटी) कानपुर से की। अपनी लगन और मेहनत से उन्होंने भारतीय राष्ट्रीय राजमार्ग अधिकरण में अभियंता के रूप में नौकरी प्राप्त की और बाद में उन्हें प्रधानमंत्री स्वर्णिम चतुर्भुज सड़क निर्माण योजना में परियोजना अधिकारी के रूप में पदस्थापित किया गया था। हत्या के समय अभियंता दुबे गया जिले में पदस्थापित थे।




मामले की सुनवाई पटना व्यवहार न्यायालय में की गयी। मामले की सुनवाई पटना की कई सत्र अदालतों में हुई। सुनवाई के दौरान भी मामला कई बार चर्चा का विषय बना जब इस मामले का एक आरोपी कई बार न्यायालय परिसर से ही न्यायिक हिरासत से पुलिस को चकमा देकर भागने में सफल रहा। बाद में पुन: उसे गिरफ्तार कर मामले की सुनवाई हुई।


मामले की सुनवाई के दौरान सीबीआई ने आरोपों को साबित करने के लिये 33 गवाहों का बयान अदालत में दर्ज करवाया।


सी.बी.आई. ने अपने पहले गवाह के रूप में वायदा माफ गवाह श्रवण कुमार को पेश किया जिसमें अभियंता श्री दूबे की लूट के दौरान हुयी हत्या का पूरा ब्योरा अदालत में पेश किया। सुनवाई के दौरान जब गवाह श्री दुबे के बारे में बोलते हुए काफी भावुक हो जाते थे तो कई बार न्यायालय का माहौल अत्यंत मार्मिक हो जाता था और गमगीन हो जाता था।


सीबीआई ने जिन गवाहों को न्यायालय में पेश किया उनमें अभियंता दुबे के भाई उनके सहपाठी और मित्र भी शामिल थे। सीबीआई ने न्यायालय में अभियंता दुबे के बरामद सामानों को भी न्यायालय में सबूत के तौर पर पेश किया जिसमें उनकी अटैची, उनकी बहन का जन्मकुंडली एवं अन्य जरूरी कागजात थे।


अंतत: मामला अपने अंतिम चरण की सुनवाई के दौरान त्वरित अदालत संख्या पांच के न्यायाधीश राघवेन्द्र कुमार सिंह की अदालत में आया।


सीबीआई की ओर से मामले की पैरवी जिला विधि सलाहकार ए.आर .अंसारी कर रहे थे जो सुनवाई के दौरान ही अवकाश प्राप्त कर गये। तब सीबीआई ने उन्हें इस मामले की पैरवी के लिये अपना विशेष लोक अभियोजक नियुक्ति किया जिन्होंने अंत तक इस मामले की पैरवी की।


वर्ष 2005 में अभियुक्तों के खिलाफ आरोप तय किये गये और पांच वर्षों की सुनवाई के बाद 20 मार्च 2010 को अदालत में मामले के तीनों अभियुक्तों को भारतीय दंड विधान की धारा 302 और 394 तथा अभियुक्त मंटू कुमार को अलग से शस्त्र अधिनियम की धारा 27 के तहत दोषी करार दिया।


वकील नागेन्द्र शर्मा की ओर से आज अदालत में यह बहस की गयी कि यह मामला विरलंतम से विरले मामलों की श्रेणी में नहीं आता है इसलिये इन्हें फांसी की सजा नहीं दी जानी चाहिए। दोषियों की वकील के बहस से सहमत होते हुए अदालत ने तीनों दोषियों को आजीवन कारावास की सजा सुनायी। अदालत ने अपने फैसले में कहा कि दोषियों को आजीवन कारावास की सजा दी जा रही है इसलिये अलग से अन्य धाराओं में कोई सजा नही दी गयी है।


तीनों दोषियों को आज जेल से लाकर अदालत में पेश किया गया। सजा सुनाने के बाद अदालत ने तीनों दोषियों को सजा भुगतने के लिये वापस जेल भेज दिया।

The Inside Story
Satyendra Kumar Dubey (Hindi: सत्येन्द्र कुमार दूबे)(1973 - 27 November 2003) was a project director at the National Highways Authority of India (NHAI). He was murdered in Gaya, Bihar after fighting corruption in the Golden Quadrilateral highway construction project.


Early life
Satyendra K. Dubey, the son of Bageshwari Dubey and Phulamati Devi, was born at the village of Sahpur in the Siwan district of Bihar, India. The family of five girls and two boys subsisted on a small piece of land, and Bageshwari also held a low-paying clerical position in a nearby sugar mill.Until the age of 15 he studied at the Gang Baksh Kanodiya High School in Sahpur and then joined junior college at Allahabad, about three hundred kilometers away. Living away from home was a considerable drain on the meager resources of his family. However, he pursued his dream of becoming an engineer, and was admitted to the Civil Engineering Department of IIT Kanpur in 1990, the first person from his village to enter an IIT. He graduated with an excellent academic record in 1994. Subsequently, he did his M. Tech (Civil Engg.) from IT-BHU in 1996.
Professional life
He was selected for the Indian Engineering Service (IES) in 1996, India's top engineering bureaucracy and joined ministry of surface transport. While at the ministry he once called the police when offered a bribe In July 2002 he was employed by the National Highway Authority of India (NHAI). Dubey became the Assistant Project Manager at Koderma, Jharkhand, responsible for managing a part of the Aurangabad-Barachatti section of National Highway 1 (The Grand Trunk Road). This highway was part of the Golden Quadrilateral (GQ) Corridor Project, the Prime Minister's initiative, which aimed to connect many of the country major cities by four-lane limited-access highways totalling 14,000 km, at an overall cost more than USD 10 billion. During this period, Dubey got the contractor of the project to suspend three of his engineers after exposing serious financial irregularities. At one point, he had the contractor rebuild six kilometers of under-quality road, a huge loss for the road contract mafia.


Exposing Corruption
The GQ project had strict controls to ensure that the construction work would be carried on by experienced firms with proper systems. A second independent contract was given for supervision of the project. However, Dubey discovered that the contracted firm, Larsen and Toubro, had been subcontracting the actual work to smaller low-technology groups, controlled by the local mafia. When he wrote to his boss, NHAI Project Director SK Soni, and to Brig Satish Kapoor, engineer overlooking the supervision, there was no action. According to the police's First Information Report (FIR) after his murder, Dubey had been facing several threats following his action against corruption at Koderma. A subsequent FIR filed by the Central Bureau of Investigation (CBI) named both Soni and Kapoor. In August 2003 when he was transferred to Gaya, a transfer which he opposed since he felt that it did not serve the interests of NHAI. At Gaya, he exposed large-scale flouting of NHAI rules regarding sub-contracting and quality control. At this time he took a departmental test and was promoted as deputy general manager, which made him eligible to take charge as project director. Since there was no project director's post in Gaya, he was likely to be posted to Koderma soon. There was widespread sentiment (based on their pattern of operation), that the criminal nexus, opposed to having him as director, may have been behind his murder.
Letter to the Prime Minister
Meanwhile, faced with the possibility of high-level corruption within the NHAI, Dubey wrote directly to the Prime Minister, Atal Bihari Vajpayee, detailing the financial and contractual irregularities in the project. While the letter was not signed, he attached a separate bio-data so that the matter would be taken more seriously. Despite a direct request that his identity be kept secret and despite the letter's sensitive content, accusing some of Dubey's superiors, the letter along with bio-data was forwarded immediately to the Ministry of Road Transport and Highways. Dubey also sent the same letter to the Chairman of the NHAI. Soon Dubey received a reprimand: the vigilance office of NHAI officially cautioned Dubey for the impropriety of writing a letter directly to the Prime minister. In the process, through connections in the NHAI and the Ministry, it is likely that the letter may have reached the criminal nexus running the highway construction projects in Bihar. Following the event, pressure is mounting in India to incorporate a Whistleblower Law.


Great Loot of Public Money: Contents of Letter
The letter said the NHAI officials showed a great hurry in giving mobilisation advance to selected contractors for financial consideration. "In some cases the contractors have been given mobilisation advance just a day after signing the contract agreement."


"The entire mobilisation advance of 10 per cent of contract value, which goes up to Rs 40 crore (USD 10 million) in certain cases, are paid to contractors within a few weeks of award of work but there is little follow up to ensure that they are actually mobilised at the site with the same pace, and the result is that the advance remains lying with contractors or gets diverted to their other activities," it said.
Dubey also highlighted the problems of sub-contracting by the primary contractors like Larsen and Toubro.
"Though the NHAI is going for international competitive bidding to procure the most competent civil contractors for execution of its projects, when it comes to actual execution, it is found that most of the works, sometimes even up to 100 per cent are subcontracted to petty contractors incapable of executing such big projects," he said. Everyone in the NHAI is aware of the phenomenon of subcontracting but looked the other way. "A dream project of unparalleled importance to the Nation but in reality a great loot of public money because of very poor implementation at every state." wrote Dubey. Finally, he ends: "I have written all these in my individual capacity. However, I will keep on addressing these issues in my official capacity in the limited domain within the powers delegated to me," the letter said.


Murder
On November 27, 2003, Dubey was returning from a wedding in Varanasi, and called his driver to meet him at the station. He reached Gaya railway station at three in the morning, and found that the car was not able to come because of a battery malfunction. It appears that at this point Dubey decided to take a rickshaw home. When he didn’t reach home, his driver went to look for him and found him dead by the side of the road in the suburb of A.P. Colony. He had been shot. The news ignited tremendous public hue and cry. The matter was raised in Parliament, and the Prime Minister shifted the onus of investigation from the Bihar Police (who might themselves be implicated), to the CBI. The CBI registered a case against unknown persons under 120-B (criminal conspiracy) and 302 (murder) of Indian Penal Code and various provision under the Arms Act on December 14, 2003.


The investigation
In early investigations, the CBI interrogated the rickshaw puller Pradeep Kumar who was caught using Dubey's stolen cell phone. The mobile phone had been switched off for about a fortnight after the murder, but then Kumar called his 'second wife' in Kolkata, following which the CBI traced the rickshaw puller to his slum in Gaya. Although Kumar had a criminal history in similar cases of robbery, it appears he was released after interrogation, and could not be traced a month later. Two other suspects, Sheonath Sah and Mukendra Paswan, were questioned by the CBI. They were found dead from poisoning on February 1, 2004, within 25 hours of the CBI questioning. Sah's father lodged an FIR against the CBI with the Bihar Police, but CBI Director Umashanker Mishra called their deaths a suicide in a press meeting a few days later. The CBI later arrested four persons, Uday Mallah, Mantu Kumar, Tutu Kumar and Babloo, all belonging to Katari village of Gaya on June 6, 2004. On June 13, the CBI arrested another accused Sarvan Paswan. In conclusion of its investigations, CBI arraigned four persons on September 3, 2004. Based on testimony by Pradeep Kumar, who was his rickshaw puller, the event was presented as an attempted robbery. Because Satyendra put up a fight about giving up his briefcase, he was shot. The person accused of actually shooting Dubey with a country-made pistol was Mantu Kumar, son of Lachhu Singh, of Village Katari, Gaya district. Accomplices with him included Uday Kumar, Pinku Ravidas and Shravan Kumar.


Murderer escapes
Mantu Kumar was arrested from near his home in Panchayatee khada in Gaya. He had apparently been living in Gaya town and working as a rickshawpuller. On September 19, 2005, while the case was being heard in Patna, Bihar in the court of Addl. Session Judge, J M Sharma, Mantu Kumar escaped from the court premises, leading to widespread allegations of police complicity. While Mantu was being held at the high security Beur Jail, the invigilation can be lax during such court appearances, and it is a common tactic of the mafia to organize a few policemen to make it possible for the criminal to escape. It was felt that the escape was engineered by higher-ups who may have executed the murder through Mantu Kumar. The CBI announced a cash reward of Rs. 1 Lakh for apprehending Mantu.


Who ordered the murder?
It is possible that Dubey may have been the victim of a simple robbery during which Mantu Kumar shot him, as alleged in the case filed by CBI. However, given the death and disappearance of several witnesses and the startling escape of the prime accused, there is widespread speculation that vested interests may have engaged the criminals who actually pulled the trigger. As for the GQ project, the Supreme Court is currently overlooking investigations into the corruption charges initially raised by the Dubey letter. Several official have been indicted and a technical team is overseeing the actual construction. Also, as of September 2005, news reports indicated that the law ministry was about to introduce legislation to protect whistleblowers. Meanwhile, on 10 February 2006, a 600 meter stretch of the GQ highway connecting Kolkata to Chennai subsided into the ground, opening up ten meter gorges near Bally, West Bengal. This stretch had been executed as a joint venture between two Malaysian firms RBM and Pati, selected after global tendering.


Conviction
More than six years after the murder, on March 22, 2010 Patna Court convicted three accused Mantu Kumar, Udai Kumar and Pinku Ravidas for murdering Dubey. The court convicted accused Mantu Kumar under Indian Penal Code (IPC) section 302 (Murder), 394 (Voluntary causing hurt in committing robbery) and 27 (A) Arms Act for possessing unlicensed weapon.The other two accused were convicted under Section 302/34 (Murder committed in furtherance of common intention) and 394 IPC.


Legacy
Dubey's murder drew several protests in India and abroad, especially by the media. Student and Alumni bodies of IITs took the lead in raising this issue. S. K. Dubey Foundation for Fight Against Corruption was founded in the US by Ashutosh Aman (IIT Kanpur, Satyendra's batchmate) and Atal Bansal (IIT Kanpur) to systematically fight against corruption. IIT Kanpur instituted an annual award in his name, Satyendra K Dubey Memorial Award, to be given to an IIT alumnus for displaying highest professional integrity in upholding human values. Arvind Kejriwal, a recipient of this award, went on to receive the Ramon Magsaysay Award as well. The Indian Express also announced a fellowship in the name of Dubey. Satyendra Dubey was recognised posthumously by several awards, which included the Whistleblower of the year award from the London-based Index on Censorship, the Transparency International's Annual integrity award and the Service Excellence award from the All India Management Association. On November 26, 2007 NDTV aired a documentary by Mini Vaid on Satyendra Dubey, produced by Ashutosh Aman on behalf of the S K Dubey Foundation. Famous Indian musician Rabbi Shergill has dedicated one stanza in his song titled 'Bilqis (Jinhe Naaz Hai)' from album Avengi Ja Nahin to Satyendra Dubey. This song is a dedication to all those who died in vain or while supporting some cause (anti-corruption).


Institute for Research and Documentation in Social Sciences (IRDS), a Non-governmental organization from Lucknow has been awarding the Satyendra Dubey award for government services in reverence to his contributions to the cause of fighting corruption.

Jai Kumar lived with his parents in Narnond, Hariyana, he was a school master who was on his way to School but fails to reach, as he gets murdered by 4 unknown villagers residing in the same village. Jai's Parents were shocked as Cops inform them about his death later, Cops comes to know that Jai's friends Manish and Krishna are missing and later, they even got to know that Om Prakash laal who was winning the Kushti competition from since past 3 years, but lost the match against a newcomer Master Jai Kumar in the village. Cops had earlier warned Jai and Om Prakash to end the fight forever but this didn't go to well with Om Prakash who firmly decided to take the revenge by killing Jai. Will Haryana Police succeed in arresting Om Prakash and his friends?



Chandigarh:

In a major breakthrough, Haryana police have solved the murder mystery of a teacher of Thurana village by arresting three accused, who confessed their involvement in the crime on October 20, 2011 at Thurana village in Hisar. They have been identified as Vinod, a resident of Thurana, Amit and Jagdeep alias Sonu of Rajli and Narnaund respectively.



According to police, the accused had murdered the teacher in order to take revenge. The three were nabbed when they were planning to rob the passerby near Kheri Jalab village road in Narnaund on Sunday evening. The police also recovered a 9 mm pistol, 5 live cartridges and an iron rod from them. The police produced the accused in the court on Monday and have taken them on remand for further investigation.



During the interrogation, Vinod, one of the main accused, confessed that he had hatched a plan to murder Shiv Kumar to take revenge on an incident occurred during a wrestling competition at their village sometime back. The accused said Kumar had beaten him up along with the help of Bittu and Sonu belonging to the same village.



To this, the accused confessed that he planned to murder him with the help of his friends, Amit and Jagdeep. On the day of the incident, they were travelling in a car and fired at the teacher when he was on his way to school.



Vinod also revealed that they wanted to eliminate Sonu and Bittu, who were also involved in beating him up. The accused were produced in the local court on Monday and investigation on in the case.
