Crime Patrol: Bar girl Kalaj Sharma (Payal-32) murderer nabbed in J&K after 3 months

The Inside Story
Monday, July 23, 2012

After three months of tireless probe, the Chembur Police finally managed to nab the alleged murderer of a 32-year-old bar girl. The alleged accused Amandeep Singh (29) was hiding in Jammu & Kashmir after committing the crime three months ago.

The reason for murder was that the accused wanted to go to Australia. Marriage with the victim, viz. Inderjeet alias Payal Santram Bhardwaj (32), would have given easy entry to Australia. But Payal refused to marry him. Out of frustration, the dejected accused strangulated Payal and fled from the scene after committing the crime.

According to the police, the incident occurred at Jhama Chowk in a room above Dhanwantari Clinic near Krishna Bakery in Chembur. On the night of April 24 and 25 around 3.40 a.m. a loud wailing of a desperate woman was heard by a neighbour who informed the police control room. Immediately the Chembur police reached the spot but found the door lock was intact from outside.

The police then broke open the door and found Payal Bhardwaj dead. She bore strangulation mark and her tongue had stretched out. Police registered an offence of murder against unknown accused for reasons not known.

During the course of the investigation, police suspected that someone known to the victim might have stayed with her and escaped from the window after killing her. The window had no grill. Amandeep was staying at Chembur camp at the time of the incident. However, on the night of offence which was on April 24 he was seen loitering in the state of intoxication near victim’s residence. He was also escorted by some witnesses from the area while he was loitering said the police.

But during the police investigation it was found that on April 25 morning, Amandeep suddenly disappeared from Mumbai leaving behind his belongings.

“On the basis of suspicion and details we gathered from our investigation, our police team went to Amritsar, Chandigarh and Jammu to locate Amandeep, but our team could not succeed in their mission. But once again, after collecting more evidence and details our police team comprising API Jadhav, PI Guge and staff was sent to J&K to trace Amandeep under the guidance of Addl CP (East region) Quaiser Khalid and DCP (Zone-VI) Manoj Lohiya and ACP Milind Bise,” stated Senior PI Bhimrao Rathod of Chembur police. “Now the Kurla court has given Amandeep police custody till July 27. He had confessed to his crime,” revealed the senior PI.

Sonali Mukherjee undergoes plastic surgery

August 29, 2012, New Delhi
Watch full story and Crime Patrol version of Sonali Mukherjee case here.

It was a big day for the acid attack victim from Jharkhand's Dhanbad district -- Sonali Mukherjee -- as she underwent yet another surgery on Tuesday hoping to regain a near-normal face, which was badly charred following her tormentor's inhuman act about a decade ago.

Though she had faced as many as 22 surgeries in last nine years, the latest one was different in the way that it was the first time that she could be given the best possible treatment and medical facilities in her fight to get back a face as close to normal as possible.

Headlines Today
has been running a campaign for Sonali seeking justice and best medical treatment to her. Though she has got support from the common citizens of the country, the Centre and the state government have not extended any real or logistical support as yet.

The surgery began at 10.30 am and lasted about five hours. It was a part of a series of surgeries that would take place at the multi specialty hospital over the next 12 months.

Senior consultant for plastic and reconstructive surgery Dr A.S. Bath said, "We are going to put tissue expanders in her scalp so that we can reconstruct her scalp. She has a large patch of aloepacia on the right side of scalp which is without hair so we will be expanding the normal scalp so that scalp will be used for reconstructing the area where the scar is. Second thing that we are going to do is the reconstruction of her upper eyelids on both the sides and lower eyelid on right side. She has got contracture of eyelids. We are going to release the eyelids and put skin graft there so that she can close the eyelids."

Dr Sanjeev Bagai of BL Kapur Hospital said, "We will put our best foot forward. Best team put together. This is the first amongst a series of surgeries which we have planned out over a period of 12 months. Our aim is to give her some quality of life. I understand the limitations of surgery that we will not be able to give her face like what God had given her, but we will try our best in this hospital whatever we can comprehensively combined as a team. We pray for her that she recovers well and recovers soon and her spirit remains exactly the same."

Sonali, who has been battling her severe injuries hoping to fight her way back to the life that she had dreamt for herself, thanked people for helping her. "I only want to say thank you to everyone, to God, the team of doctors and all of you. I hope to recover soon," she said.

Crime Patrol: Latest - Acid attack victim Sonali set to get govt job in Jharkhand (Episode 146 on 24 Aug 2012)

Watch here the crime patrol episode of Sonali's case

Keeping the promise made by Chief Minister Arjun Munda, the state home department has completed the paperwork for the appointment of acid attack victim Sonali Mukherjee.

The Dhanbad administration has submitted the detailed report and recommendations regarding Sonali's appointment to the Home department according to her ability and qualification.

"We have sent the recommendation for Government job to Sonali Mukherjee to the Home Secretary along with sanctioning a special pension for her mother," said Bokaro DC Sunil Kumar, in additional charge of Dhanbad Deputy Commissioner at present. "Proper security has also been provided to her family," added Kumar.

Sonali's family had already been allotted a house under Indira Awas scheme by the Government after the matter was highlighted by media.

Depending on her educational qualification and physical abilities, Sonali will be appointed on a suitable position.

The department is now waiting Sonali to submit her certificates and join the service. Currently she is in Delhi for her treatment.

Confirming the development, principal home secretary J B Tubid said the formalities have been completed by the department on directives from the chief minister. Depending on her educational qualification and physical abilities, Sonali will be appointed and posted to a suitable job.

"The department is waiting for Sonali to submit her certificates and join service. She has gone for treatment after meeting the chief minister. The moment she submits her certificates, we will give her the appointment letter. We want to post her at a place which suits her best," said Tubid

Sonali had become completely blind and partially deaf after the acid attack by three youths in 2003 causing serious injury to her face. Since then, she has been campaigning for justice and also met the chief minister requesting for a suitable job.

However, for nine years, justice eluded her and her perpetrators still roam scot-free. Losing all hopes of justice, she had even demanded euthanasia earlier as her family found it hard to cope with her medical bills.

Sonali now wants that no other girl endure a misery like her. "Now that I have regained my energy, I want to meet the newly elected President. My demand is to change the customary section of this crime. Culprits should be booked under more a severe Section (of IPC)," she says.

"I will also ask the President to provide me with a job, so I can support myself and my family, which has lost everything in this battle," says Sonali, who still has a long way to go in her fight for justice.

Crime Patrol :Give me justice or let me die: Desperate plea of acid attack victim who was left blind and deaf by the three men who had 'sexually abused her' (Episode 146, 147 on 24-25 Aug 2012)

Inside Story
Just in (Ranchi, August 24, 2012)Sonali to get govt job in Jharkhand

Sonali Mukherji remembers that April 22 night, the night when everything went dark for her and her family.

Nearly 10 years after being targeted by her jilted “lover” and two of his accomplices, the acid continues to seep into the life and corrode the happiness of the Mukherji family.

Sonali (27), who came to Bokaro on Saturday to seek financial help from the state women’s commission, has been living with a tale of horror.

“The acid attack took away my eyesight. But that was just the beginning of trauma for me and my family. My father Chandidas Mukherjee was employed with a private company in Dhanbad at the time of the incident. He had to quit his job to be by my side after the attack and my family shifted to our ancestral home in Kasmar,” Sonali told The Telegraph outside the women’s commission office in Bokaro.

She quickly added that ever since the attack, she and her family had been living in fear of a rerun of the 2003, more so now with her tormentors out on bail.

“We are scared but helpless. They have threatened to attack us again. My family has sent my younger brother away to live with my maternal uncles,” Sonali said.

The trio — Telipara resident Tapas Mitra, whose marriage proposal had been turned down by Sonali, and his aides Sanjay Paswan and Bramhadev Hazra — had been arrested by the police five days after the attack. They had managed to get into the Bhelatand residence of the girl through the terrace. They fled after pouring sulphuric acid on Sonali, and injuring her younger sister Soma, who happened to be with her. The victim’s father who tried to catch the attackers also suffered burns.

All the three youths were sentenced to nine years of imprisonment by the court of the district and session judge. They later managed to secure bail from the high court.

“I receive Rs 200 per month from the government as disability allowance for being physically challenged. The entire amount is used to buy medicines. The acid was so strong that I still feel pain in my eyes,” Sonali, who suffered 65 per cent burns, said.

She added that apart from her disability allowance, her grandmother received Rs 400 per month as old age pension.

“That, along with the little that my father manages to earn working as a priest, keeps the fire burning in our kitchen,” she said.

The victim, who could not meet state women’s commissioner Hemlata S. Mohan on Saturday, said that she would come back to seek protection for her family later.

Should pregnancy of mentally challenged rape victim be ended? (Episode 144 on 18 aug 2012)

Inside Story
Should pregnancy of mentally challenged rape victim be ended? SC will decide today

New Delhi, Tue Jul 21 2009

Should a pregnant, mentally challenged woman who was raped be allowed to exercise her right to motherhood or should her unborn child be aborted as she conceived after being raped?

Faced with this question, the Supreme Court today stayed the July 17 order of the Punjab and Haryana High Court which had ordered immediate termination of the woman’s pregnancy.

Moved by the plight of this woman — she is an orphan who was raped, allegedly by the staff of a Nari Niketan in Chandigarh, and is now in her 20th week of pregnancy — the bench of Chief Justice K G Balakrishnan and Justice P Sathasivam found it difficult to take an immediate decision on her case.

Seeking to know her mental and physical capabilities, the bench asked about the woman’s age and intelligence level.

After the expiry of the 20th week of pregnancy, it is illegal to abort a foetus as per provisions of the Medical Termination of Pregnancy Act.

Realising that time was running out for the woman, the bench issued notice to the Chandigarh administration and posted the matter for a final decision tomorrow.

Advocate Tanu Bedi, who argued the case on behalf of the expecting woman, said she was 19 to 20-years-old but had the IQ of a nine-year-old. This made the bench observe: “She may be an adult but has got the intelligence of a nine-year-old.”

To Bedi’s argument that India is a pro-life country and unless a mother’s express consent is there, termination of pregnancy is illegal, the CJI observed, “with a mind of a nine-year-old, how will she react to situations especially after the birth, is not known.” “And whether the child too be mentally retarded?” asked the bench.

Bedi defended the rights of a mentally challenged woman, supporting her case with two reports from a panel of doctors constituted by the Punjab and Haryana HC in coming to the decision.

She reminded the bench that India was a signatory to the 2006 UN convention which recognizes rights of mentally challenged persons.

Finding it difficult to agree with the lawyer’s submissions, the CJI remarked: “All this may be the aspirations of a nine-year-old. But then she may have so many other aspirations too. We have to look at the overall situation considering her position and that of a child who will be born.”

On perusing the strong arguments by Bedi, the bench said “mental retardation could not be a ground for termination of pregnancy.”

Following detection of pregnancy, the Chandigarh administration had earlier came to the conclusion that in her best interest, the woman, now approaching the critical 20th week of pregnancy, needed to undergo a medical abortion. The administration moved the Punjab and Haryana High Court seeking a nod for the decision. On July 17, the High Court gave the administration the go-ahead to have the pregnancy medically terminated.

Mentally challenged rape victim: CJI says why abort child

New Delhi, Wed Jul 22 2009

The Supreme Court on Tuesday allowed a mentally challenged woman who had conceived after being raped in a Nari Niketan in Chandigarh, to give birth to her baby.

A bench headed by Chief Justice K G Balakrishnan stayed the Punjab and Haryana High Court decision of July 17, 2009 where the Chandigarh administration was directed to abort her foetus immediately. “We stay the operation of the High Court order,” the court observed.

The woman, now residing in another state-run shelter home, is in her 20th week of pregnancy. After the expiry of this week, medical termination of pregnancy would be illegal as per the law.

“We are sure she will not be in a position to give protection or post-natal care to the child. But that can be taken care of by somebody else,” noted the CJI.

After being satisfied that several national-level NGOs had come forward to take responsibility of the child, the three-member bench was reluctant to accept any other arguments supporting her abortion.

“If there are no further complications to the woman in continuation of her pregnancy, then why abort a life?” the CJI posed this query to UT administration counsel Anupam Gupta and to the counsel for one social worker, senior advocate Colin Gonsalves, who were pressing for abortion.

Advocate Tanu Bedi, who argued on behalf of the woman, submitted, “It would be a travesty of justice if a mother has to come to the highest court of the land to seek permission to give birth to her own child.”

The bench, noting that “nature has its own way of providing protection”, put several queries to psychologist Dr Paramleen Kaur and a gynaecologist who was a part of the panel of PGI doctors, which had examined the woman earlier. Both the doctors were present in the court.

Acknowledging that if a baby is aborted against her wishes, it would cause further trauma to the woman, the court ordered that the baby should be born with “mother under constant care and supervision”.

Sakshi kills her own uncle with husband's help (Episode 139 on 10 Aug 2012)

Crime Patrol: Prajakta (Sakshi) kills rapist uncle with her husband's help (Episode 139 on 10 Aug 2012)

The deceased, a Mantralaya employee, had for long been forcing his niece to have sex with him; when she revealed this to her husband after marriage, the two hatched a plan and bludgeoned the uncle to death

The Dombivli police have arrested a woman and her husband for killing her uncle, who would allegedly threaten her into having sex with him.

According to the Vishnu Nagar police, the body of Santosh Shankar Pawar, a 40-year old Mantralaya employee, was discovered on July 9 near a playground at Anupam Nagari in Dombivli (West).

Rapist chacha: Santosh Shankar Pawar, the victim, would threaten his niece Prajakta into having sex with him; when this persisted even after her marriage, she told her husband, who roped in three friends and murdered the uncle. Pic/Navneet Barhate

Checking their records for missing people, they discovered that one Arjun Gangaram Shinde had reported recently that his uncle had gone missing.

“Arjun identified his uncle’s body, and revealed that he worked in Mantralaya at the co-operative bank,” said Rajendra Kulkarni, senior police inspector of Vishnu Nagar police station.

In course of investigating Pawar’s death, the cops questioned his relatives, to find out if he had acquired any enemies of late. They learnt from Arjun that Pawar was last seen with Prasad alias Goli Shashikant Bhoiyer, his niece Prajakta’s husband. Prajakta and Bhoiyer had been married just a month back.

The cops then summoned Bhoiyer to the police station. “After a while, Bhoiyer told us that he had married Prajakata a month ago. He noticed that Prajakta would always be mentally disturbed — she eventually revealed that her uncle, Pawar, had been forcing her to have sex with him. He had not stopped making his demands even after her marriage,” said Kulkarni.

This angered Bhoiyer, who, along with his friends Ashish Gadigoankar, Sanket Dalvi and Hemant Padhir, planned the murder – they took Pawar to the playground, smashed his head with a stone and fled the spot. The police have arrested Prajakta, Bhoiyer, and three accomplices on charges of kidnapping and murder.
